Introduction

This Privacy Policy (“Policy”) is governed by the Terms of Use (“Terms”) and applies to the website www.easyreach.ph by HealthSense, Inc. (“Platform”), and the content, products and services (collectively referred to herein as “Products”) available therein. This Policy explains what personal information EasyReacH collects from the users of the Platform, how EasyReacH uses or processes that information, and what options you have with respect to the information EasyReacH collects about you.

Consent

By accessing or using the Platform, you acknowledge that you have read, understood and agreed to be legally bound by and comply with this Policy and our Terms.

If any term in this Policy is unacceptable to you, please do not use the Platform or provide any Personal Information.

Change

EasyReacH reserves the right to change from time to time this Policy, and Secured Users may be required by the Platform to express their acceptance to the changes in the Policy.

Your continued use of the Platform after we make changes shall be deemed to be an acceptance of those changes, so please check this Policy periodically for updates.

Information that EasyReacH Collects About You and Why

EasyReacH collect several types of information from and about users of the Platform, including information:

• By which you may be personally identified, such as name, e-mail address, telephone number, or any other information collection on the Platform that is defined as personal data or personally identifiable information under the applicable law (“personal information”);

• That is about you but individually does not identify you, such as whether you are a current user, product interests, or information related to your inquiry or request;

• About your internet connection, the equipment you use to access the Platform, and usage details; and/or

• About your medical condition, treatment options, physician referrals, and prescriptions, including protected health information or other related health information.

Note that all collection of information shall only be done when the consent of the user has been secured.

We collect this information:

• Directly from you when you provide it to EasyReacH.

• Automatically as you navigate through the Platform. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

• From third-party intermediaries, for example, the physicians, medical professionals, and pharmacies with whom EasyReacH partners to provide you with services.

Information You Give to Us. The information EasyReacH collects on or through the Platform may include:

• Information that you provide on the Platform. This includes information provided when you sign up for its Products; when EasyReacH process or respond to your inquiries related to requests for treatment, payment, customer service; and when you provide feedback on the Platform.

• Your responses to questions that we might ask you to complete for research purposes.

• Details of transactions you carry out through the Platform and of the fulfillment of your inquiries or requests.

• Your search queries on the Platform.

• Your responses to medical-history questionnaires you are required to answer in order to be able to obtain a prescription, a precondition for ordering prescription drugs. 

Information We Collect About You. As with many other websites and mobile applications, as you navigate through and interact with the Platform, EasyReacH may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

• Details of your visits to the Platform, including traffic data, location data, logs, language, date and time of access, frequency, and other communication data and the resources that you access and use on the Platform.

• Information about your computer and internet connection, including your IP address, operating system, host domain, and browser type.

• Details of referring websites (URL). EasyReacH also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking).

The information EasyReacH collects automatically is statistical data and may include personal information, or EasyReacH may maintain it or associate it with personal information you provide to us or that we collect in other ways or receive from third parties.  It helps EasyReacH to improve the Platform and to deliver a better and more personalized service, including by enabling EasyReacH to:

• Estimate our audience size and usage patterns.

• Store information about your preferences, allowing us to customize the Platform according to your individual interests.

• Speed up your searches.

• Recognize you when you return to the Platform.

Information We Receive from Other Sources. This is information EasyReacH receives about you if you use any of the Products we offer. EasyReacH is working closely with third parties (including, for example, third-party intermediaries, such as the physicians, medical professionals, and pharmacies with whom we partner to provide you with services, sub-contractors in technical, advertising networks, analytics providers, and search information providers).

How EasyReacH Uses Your Information

In connection with providing you with the Platform and Products, EasyReacH may use, compile, analyze, and save your information in the following ways:

• To provide you our products and, as applicable, facilitate the provision of health care services to you by a physician or other health care providers and ensure that the physicians or health care providers have the services and support necessary for health care operations.

• To communicate with you about the Platform and Products, or about your use of the Platform and Products, and to send you communications on behalf of physicians or other health care providers utilizing the Platform to help meet your needs.

• To provide you with information that you have requested or to respond to your inquiries.

• To provide you with technical support and to improve the Platform.

• To verify your identity and administer your account, including processing your payments and fulfilling your orders.

• In order to ensure that content from the Platform is presented in the most effective manner for you and for your computer or mobile phone, to allow you to participate in interactive features of its Products (when you choose to do so), and as part of our efforts to the Platform safe and secure.

• To communicate with you about its Products and those of its affiliates, related businesses or third-party partners.

• To measure or understand the effectiveness of advertising it serves to you and others, and to deliver relevant advertising to you.

• In the event of a sale, merger, consolidation, change in control, transfer of substantial assets, reorganization, or liquidation, it may transfer, sell, or assign to third parties information concerning your relationship with it, including, without limitation, personal information that you provide and other information concerning your relationship with it, provided that the successor must agree to keep all personal information and other information it will receive private and protected. 

• To notify you about changes to the Platform or Products.

• For any purpose where you have given your consent (where legally required).

• To comply with applicable law.

Information We Receive from Other Sources. EasyReacH will combine information we receive from other sources with information you give to us and information we collect about you. EasyReacH will use this information and the combined information for the purposes set out above (depending on the types of information we receive).

Disclosure of Your Information

As a general rule, EasyReacH may not disclose your personal information to third parties, except in the following cases:

• You have given your consent, specific to the purpose prior to the processing, or in the case of privileged information, all parties to the exchange have given their consent prior to processing, this includes, but is not limited to, processing of payments through third-party service providers;

• The processing of the same is provided for by existing laws and regulations;

• The processing is necessary to protect the life and health of the data subject or another person, and the data subject is not legally or physically able to express his or her consent prior to the processing; or

• The processing is necessary for purposes of medical treatment, is carried out by a medical practitioner or a medical treatment institution, and an adequate level of protection of personal information is ensured.

 

Options on How EasyReacH Uses and Discloses Your Information

EasyReacH strives to provide you with options regarding handling of the personal information you provide to us. EasyReacH has created mechanisms to provide you with the following control over your information.

Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.  If you disable or refuse cookies, please note that some parts of the Platform may then be inaccessible or not function properly.

Do Not Track. EasyReacH does not currently respond to “do not track” signals as it does not track our customers across third-party websites.

Promotional Offers from EasyReacH. If you do not wish to have your contact information used by EasyReacH to promote our own Products, you will have the ability to opt out at any time. You may request opt-out on promotional communication by contacting us at the address below. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.

EasyReacH does not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

 

Accessing, Correcting and Deleting Your Information

You may contact us at the address below or by email at customercare@easyreach.ph,   to request access to, correct, or delete any personal information that you have provided to it. There is a chance EasyReacH may not be able to delete your personal information except by also deleting your user account. You may also choose to delete your account yourself at any time, however, by doing so your medical and order records will be permanently deleted from the site. If EasyReacH deletes your user account, medical providers and other affiliates may still have the right to retain information as required by applicable law, regulations, or their own retention policy. EasyReacH may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. Unless otherwise required by law, EasyReacH will also erase personal information when the personal information is no longer necessary in relation to the purposes for which it was collected or otherwise processed; when you withdraw your consent (where lawfulness of processing was based on your consent) and there is no other legal ground for the processing; when you object to the processing and there are no overriding legitimate grounds for the processing; when your personal information has been unlawfully processed; and when it is necessary to comply with legal obligations.

Data Security

EasyReacH has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Where EasyReacH has given you (or where you have chosen) a password that enables you to access certain parts of the Platform, you are responsible for keeping this password confidential. EasyReacH asks you not to share a password with anyone. The information you share in public areas may be viewed by any user of the Platform.

Unfortunately, the transmission of information via the Internet is not completely secure.  Although EasyReacH will do its best to protect your personal information, we cannot guarantee the security of your data transmitted to the Platform; any transmission is at your own risk.

Third Parties

This Privacy Policy does not address, and EasyReacH is not responsible for, the privacy, information, or other practices, including data privacy and security process and standards of the manufacturer of your mobile device and other IT hardware and software, and any other third-party mobile application or website to which the Platform may contain a link.  These third parties may at times gather information from or about you. By accessing said links, you will be governed by their respective privacy policy.

EasyReach may share your information with its trusted partners to help it to address communications to you correctly, to provide customer support, to arrange for deliveries, to accurately evaluate health conditions pertinent to contraception, or to perform statistical analysis. All such third parties are prohibited from using your personal information for any other purpose than providing these services on EasyReach's behalf, and they are required to maintain the confidentiality of your information.
